{"id":2298,"date":"2020-03-27T15:36:58","date_gmt":"2020-03-27T15:36:58","guid":{"rendered":"https:\/\/www.ascent-avocats.fr\/?p=2298"},"modified":"2020-04-23T15:40:24","modified_gmt":"2020-04-23T15:40:24","slug":"flash-info-covid-19-n3","status":"publish","type":"post","link":"https:\/\/www.ascent-avocats.fr\/en\/flash-info-covid-19-n3\/","title":{"rendered":"Flash Info Covid-19 N\u00b03"},"content":{"rendered":"<h4><a href=\"https:\/\/www.ascent-avocats.fr\/wp-content\/uploads\/2020\/04\/Flash-Info-Ascent-N3-Ordonnance-n2020-346-du-27-03-20-.pdf\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-2319 aligncenter\" src=\"https:\/\/www.ascent-avocats.fr\/wp-content\/uploads\/2020\/03\/index.png\" alt=\"\" width=\"160\" height=\"98\" \/><\/a><\/h4>\n<h4 style=\"text-align: center;\">\u27a2 Ordonnance n\u00b02020-346 du 27 mars 2020<br \/>\nportant mesures d\u2019urgence en mati\u00e8re d\u2019activit\u00e9 partielle<\/h4>\n<p>A la suite du d\u00e9cret n\u00b0 2020-325 du 25 mars 2020 relatif \u00e0 l&#8217;activit\u00e9 partielle, <strong>l\u2019ordonnance n\u00b02020-346 du 27 mars 2020 portant mesures d\u2019urgence en mati\u00e8re d\u2019activit\u00e9 partielle<\/strong>, publi\u00e9e au JO du 28 mars 2020<\/p>\n<p>&#8211; <strong>Am\u00e9liore<\/strong> l\u2019indemnisation de certaines cat\u00e9gories de salari\u00e9s,<\/p>\n<p>&#8211; <strong>\u00c9largit<\/strong> le dispositif \u00e0 de nouveaux b\u00e9n\u00e9ficiaires,<\/p>\n<p>&#8211; <strong>Fixe<\/strong> pour partie les modalit\u00e9s d\u2019indemnisation des salari\u00e9s non soumis \u00e0 la dur\u00e9e du travail ou au forfait jours,<\/p>\n<p>&#8211; <strong>Aligne<\/strong> les conditions d\u2019indemnisation des salari\u00e9s en formation pendant la p\u00e9riode d\u2019activit\u00e9 partielle sur les conditions de droit commun des salari\u00e9s en activit\u00e9 partielle,<\/p>\n<p>&#8211; <strong>Supprime<\/strong> l\u2019accord en principe requis des salari\u00e9s prot\u00e9g\u00e9s pour leur mise en activit\u00e9 partielle, \u00e0 certaines conditions.<\/p>\n<p>&#8211; <strong>Adapte<\/strong> temporairement le r\u00e9gime social des indemnit\u00e9s d\u2019activit\u00e9 partielle et indemnit\u00e9s compl\u00e9mentaires vers\u00e9es par l\u2019employeur<\/p>\n<p>&nbsp;<\/p>\n<h5>1.\u00a0 L\u2019am\u00e9lioration de l\u2019indemnisation de certaines cat\u00e9gories de salari\u00e9s<\/h5>\n<ul>\n<li>L\u2019indemnisation des salari\u00e9s des <strong>secteurs soumis au r\u00e9gime d\u2019\u00e9quivalence<\/strong> inclut les heures d\u2019\u00e9quivalence, compte tenu de l\u2019impact tr\u00e8s significatif de la crise sanitaire et de ses cons\u00e9quences sur l\u2019activit\u00e9 de ces secteurs. La dur\u00e9e consid\u00e9r\u00e9e comme \u00e9quivalente est prise en compte en lieu et place de la dur\u00e9e l\u00e9gale du travail pour le calcul de l\u2019indemnit\u00e9 et de l\u2019allocation d\u2019Activit\u00e9 partielle.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Le taux horaire de l\u2019indemnit\u00e9 d\u2019Activit\u00e9 partielle vers\u00e9e aux <strong>salari\u00e9s \u00e0 temps partiel<\/strong> ne peut \u00eatre inf\u00e9rieur au taux horaire du SMIC soit, 10,15 euros bruts. Si le taux horaire de l\u2019indemnit\u00e9 d\u2019Activit\u00e9 partielle est inf\u00e9rieur au taux horaire du SMIC, le taux horaire de l\u2019indemnit\u00e9 qui lui est vers\u00e9e est \u00e9gal \u00e0 son taux horaire de r\u00e9mun\u00e9ration. Dans ce cas donc, le salari\u00e9 \u00e0 temps partiel est indemnis\u00e9 \u00e0 100%.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Les salari\u00e9s en <strong>contrat d\u2019apprentissage ou de professionnalisation<\/strong> re\u00e7oivent une indemnit\u00e9 horaire d\u2019activit\u00e9 partielle de leur employeur, d\u2019un montant \u00e9gal au pourcentage du SMIC qui leur est applicable selon les dispositions du Code du travail. Il en r\u00e9sulte que la r\u00e9mun\u00e9ration per\u00e7ue par cette cat\u00e9gorie de salari\u00e9s est int\u00e9gralement maintenue.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h5>2. L\u2019\u00e9largissement de l\u2019Activit\u00e9 partielle \u00e0 de nouveaux b\u00e9n\u00e9ficiaires<\/h5>\n<ul>\n<li>Les salari\u00e9s des <strong>entreprises \u00e9trang\u00e8res ne comportant pas d\u2019\u00e9tablissement en France<\/strong> lorsque celles-ci sont soumises au r\u00e9gime fran\u00e7ais de s\u00e9curit\u00e9 sociale et de l\u2019assurance ch\u00f4mage.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Les <strong>entreprises publiques<\/strong> qui s\u2019assurent elles-m\u00eames contre le risque de ch\u00f4mage, en b\u00e9n\u00e9ficient. Les sommes mises \u00e0 la charge de l\u2019organisme gestionnaire du r\u00e9gime d\u2019assurance ch\u00f4mage seront rembours\u00e9es par ces entreprises dans des conditions qui seront d\u00e9finies par d\u00e9cret.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<ul>\n<li>Les salari\u00e9s des <strong>r\u00e9gies dot\u00e9es de la seule autonomie financi\u00e8re qui g\u00e8rent un service public \u00e0 caract\u00e8re industriel et commercial de remont\u00e9es m\u00e9caniques ou de pistes de ski<\/strong>, sont int\u00e9gr\u00e9s dans le dispositif d\u2019Activit\u00e9 partielle. Ils en avaient \u00e9t\u00e9 b\u00e9n\u00e9ficiaires, \u00e0 titre exp\u00e9rimental et pour une dur\u00e9e de trois ans, par l\u2019effet de la loi n\u00b02016-1888 du 28 d\u00e9cembre 2016 de modernisation, de d\u00e9veloppement et de protection des territoires de montagne.<\/li>\n<\/ul>\n<p>*\u00a0\u00a0\u00a0 Les <strong>salari\u00e9s employ\u00e9s \u00e0 domicile par des particuliers employeurs<\/strong> et les <strong>assistants maternels<\/strong> b\u00e9n\u00e9ficieront d\u2019une indemnit\u00e9 horaire vers\u00e9e par l\u2019employeur \u00e9gale \u00e0 80% de la r\u00e9mun\u00e9ration nette pr\u00e9vue au contrat qui ne peut \u00eatre inf\u00e9rieure pour les employ\u00e9s \u00e0 domicile au salaire minimum de la CCN des employ\u00e9s du particulier employeurs et pour les assistants maternels au montant minimal pr\u00e9vu par l\u2019article L423-19 du code de l\u2019action sanitaire et sociale. Les indemnit\u00e9s d\u2019activit\u00e9 partielle sont rembours\u00e9es int\u00e9gralement par les URSSAF pour le compte de l\u2019Etat.<\/p>\n<p>&nbsp;<\/p>\n<h5>3. La fixation encore partielle des modalit\u00e9s d\u2019indemnisation des salari\u00e9s au forfait jours et des salari\u00e9s non soumis \u00e0 la dur\u00e9e du travail<\/h5>\n<p><strong>On rappelle que le d\u00e9cret n\u00b0 2020-325 du 25 mars 2020 a pos\u00e9 le principe<\/strong> que pour d\u00e9terminer le nombre d&#8217;heures permettant de justifier l&#8217;attribution de l&#8217;Allocation d&#8217;activit\u00e9 partielle pour les salari\u00e9s dont la dur\u00e9e de travail est forfaitaire, est prise en compte la dur\u00e9e l\u00e9gale correspondant aux jours de fermeture de l\u2019\u00e9tablissement ou \u00ab\u00a0<em>aux jours de r\u00e9duction de l&#8217;horaire de travail pratiqu\u00e9e dans l&#8217;\u00e9tablissement, \u00e0 due proportion de cette r\u00e9duction<\/em>\u00a0\u00bb.<\/p>\n<p><strong>L\u2019ordonnance pr\u00e9cise donc<\/strong> pour ces salari\u00e9s dont la dur\u00e9e du travail que la d\u00e9termination du nombre d\u2019heures prise en compte pour l\u2019indemnit\u00e9 et l\u2019allocation d\u2019Activit\u00e9 partielle, est effectu\u00e9e en <strong>convertissant en heures un nombre de jours ou demi-journ\u00e9e<\/strong>.<\/p>\n<p><strong>L\u2019ordonnance renvoie toutefois \u00e0 un futur d\u00e9cret les modalit\u00e9s de conversion des jours ou des demi-journ\u00e9es en heures\u00a0; il en est de m\u00eame pour l\u2019indemnit\u00e9 et l\u2019allocation d\u2019Activit\u00e9 partielle vers\u00e9e par les employeurs de salari\u00e9s non soumis \u00e0 la dur\u00e9e du travail (cadres dirigeants).<\/strong><\/p>\n<p><strong>Il est donc temps que le r\u00e9gime d\u2019Activit\u00e9 partielle soit d\u00e9finitivement clarifi\u00e9 pour les salari\u00e9s soumis au forfait jours.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<h5>4. L\u2019alignement de l\u2019indemnit\u00e9 d\u2019Activit\u00e9 partielle des salari\u00e9s en formation en p\u00e9riode d\u2019activit\u00e9 partielle \u00ab\u00a0Crise Covid-19\u00a0\u00bb<\/h5>\n<p>Les formations qui ont \u00e9t\u00e9 accept\u00e9es par l\u2019employeur apr\u00e8s la publication de l\u2019ordonnance n\u00b02020-346 du 27 mars 2020 seront <strong>indemnis\u00e9es \u00e0 hauteur de 70% de la r\u00e9mun\u00e9ration brute<\/strong> et non plus \u00e0 100% du salaire net. L\u2019indemnit\u00e9 d\u2019Activit\u00e9 partielle pour ces salari\u00e9s en formation durant la p\u00e9riode d\u2019activit\u00e9 partielle \u00ab\u00a0Crise Covid-19\u00a0\u00bb est donc align\u00e9e sur le droit commun de l\u2019indemnisation de l\u2019Activit\u00e9 partielle issue de la Loi d\u2019urgence et des ordonnances.<\/p>\n<p>&nbsp;<\/p>\n<h5>5. La suppression de l\u2019accord des salari\u00e9s prot\u00e9g\u00e9s pour leur mise en activit\u00e9 partielle, sous certaines conditions<\/h5>\n<p><strong>L\u2019Activit\u00e9 partielle s\u2019impose au salari\u00e9 prot\u00e9g\u00e9<\/strong> sans que l\u2019employeur n\u2019ait \u00e0 recueillir son accord lorsqu\u2019elle affecte tous les salari\u00e9s de l\u2019entreprise, de l\u2019\u00e9tablissement, du service, ou de l\u2019atelier auquel est affect\u00e9 ou rattach\u00e9 ce salari\u00e9.<\/p>\n<p>&nbsp;<\/p>\n<h5><\/h5>\n<h5>6.
