Comme pour l\u2019ordonnance, ses dispositions sont applicables <strong>jusqu\u2019au 31 d\u00e9cembre 2020<\/strong>.<\/p>\n<h4>\u27a2 Report de certaines visites m\u00e9dicales<\/h4>\n<p>Le m\u00e9decin du travail <strong>peut reporter jusqu\u2019au 31 d\u00e9cembre 2020<\/strong>, les examens m\u00e9dicaux suivants dont l&#8217;\u00e9ch\u00e9ance survient entre le <strong>12 mars et le 31 ao\u00fbt 2020<\/strong> :<\/p>\n<p>&#8211; <strong>La visite d\u2019information et de pr\u00e9vention initiale<\/strong>, qui doit l\u00e9galement \u00eatre organis\u00e9e dans les 3 mois \u00e0 compter de la prise effective du poste de travail.<br \/>\n<strong>Sauf<\/strong> pour les travailleurs :<\/p>\n<ul>\n<li>handicap\u00e9s ;<\/li>\n<li>\u00e2g\u00e9s de moins de 18 ans ;<\/li>\n<li>titulaires d&#8217;une pension d&#8217;invalidit\u00e9 ;<\/li>\n<li>de nuit ;<\/li>\n<li>les femmes enceintes, venant d&#8217;accoucher ou allaitantes ;<\/li>\n<li>expos\u00e9s \u00e0 des champs \u00e9lectromagn\u00e9tiques (&#8216;article R. 4453-3 du code du travail).<\/li>\n<\/ul>\n<p>&#8211; <strong>Le renouvellement de la visite d\u2019information et de pr\u00e9vention<\/strong>, fix\u00e9 par le m\u00e9decin du travail en fonction du salari\u00e9, selon une p\u00e9riodicit\u00e9, laquelle ne peut exc\u00e9der 5 ans.<\/p>\n<p>&#8211; <strong>Le renouvellement de l&#8217;examen d&#8217;aptitude et la visite interm\u00e9diaire<\/strong>. Les travailleurs affect\u00e9s \u00e0 un poste pr\u00e9sentant des risques particuliers pour leur sant\u00e9 ou leur s\u00e9curit\u00e9, ou celle de leurs coll\u00e8gues et tiers, b\u00e9n\u00e9ficient l\u00e9galement d\u2019un examen par le m\u00e9decin du travail r\u00e9alis\u00e9 tous les 4 ans, et d\u2019une visite interm\u00e9diaire par un professionnel de sant\u00e9 tous les deux ans. Ces examens pourront \u00eatre report\u00e9s \u00e0 la demande du m\u00e9decin du travail.<br \/>\nToutefois, l\u2019examen m\u00e9dical d\u2019aptitude initial, qui se substitue \u00e0 la visite d&#8217;information et de pr\u00e9vention pour les travailleurs expos\u00e9s, ne peut \u00eatre report\u00e9.<\/p>\n<p>Le report de l\u2019examen d\u2019aptitude n\u2019est pas non plus possible pour les travailleurs expos\u00e9s \u00e0 des rayons ionisants class\u00e9s en cat\u00e9gorie A. Pour ceux-ci, la visite m\u00e9dicale doit \u00eatre renouvel\u00e9e annuellement.<\/p>\n<h4>\u27a2 Visite de pr\u00e9reprise<\/h4>\n<p>L\u00e9galement, une visite de pr\u00e9reprise doit \u00eatre organis\u00e9e par le m\u00e9decin du travail apr\u00e8s un arr\u00eat de travail de plus de 3 mois. Par d\u00e9rogation, lorsque la reprise du travail doit intervenir avant le 31 ao\u00fbt 2020, le m\u00e9decin du travail n\u2019est pas tenu de l\u2019organiser, sauf s\u2019il porte une appr\u00e9ciation contraire.<\/p>\n<h4>\u27a2 Visite de reprise<\/h4>\n<p>L\u00e9galement, le travailleur b\u00e9n\u00e9ficie d&#8217;un examen de reprise apr\u00e8s un cong\u00e9 maternit\u00e9, une absence pour cause de maladie professionnelle ou apr\u00e8s une absence d&#8217;au moins 30 jours pour cause d&#8217;accident du travail, de maladie ou d&#8217;accident non professionnel, dans un d\u00e9lai de 8 jours qui suivent la reprise effective du travail.<\/p>\n<p>Par d\u00e9rogation, le m\u00e9decin du travail peut reporter cet examen, sans que ce report fasse obstacle \u00e0 la reprise du travail, dans un d\u00e9lai de <strong>trois mois<\/strong> suivant la reprise du travail, d\u00e9lai r\u00e9duit \u00e0 un mois pour les travailleurs faisant l&#8217;objet d\u2019un suivi individuel renforc\u00e9.<\/p>\n<p>L\u2019examen de reprise doit \u00eatre organis\u00e9 <strong>avant<\/strong> la reprise effective du travail pour les travailleurs :<\/p>\n<ul>\n<li>handicap\u00e9s ;<\/li>\n<li>de nuit<\/li>\n<li>\u00e2g\u00e9s de moins de 18 ans ;<\/li>\n<li>titulaires d&#8217;une pension d&#8217;invalidit\u00e9 ;<\/li>\n<li>les femmes enceintes, venant d&#8217;accoucher ou allaitantes ;<\/li>\n<\/ul>\n<h4>\u27a2 Appr\u00e9ciation contraire du m\u00e9decin du travail<\/h4>\n<p>Aucune visite ou examen ne peut faire l&#8217;objet d&#8217;un report lorsque le m\u00e9decin du travail estime l\u2019examen m\u00e9dical <strong>indispensable<\/strong> au regard des informations dont il dispose concernant l&#8217;\u00e9tat de sant\u00e9 du salari\u00e9, les risques li\u00e9s \u00e0 son poste de travail ou \u00e0 ses conditions de travail.<\/p>\n<h4>\u27a2 Information de l\u2019employeur et du salari\u00e9<\/h4>\n<p>Lorsque les examens m\u00e9dicaux sont report\u00e9s, le m\u00e9decin du travail en informe l\u2019employeur et le travailleur, en leur communiquant<strong> la date \u00e0 laquelle la visite est reprogramm\u00e9e<\/strong>.
