En cas de recrutement ult\u00e9rieur, l\u2019employeur devra notamment \u00e9tablir que le poste concern\u00e9 n\u2019\u00e9tait pas vacant au moment du licenciement.<\/p>\n<p>&nbsp;<\/p>\n<h4>Inaptitude.<\/h4>\n<p><strong>Cass. soc., 8 juillet 2020, n\u00b0 19-14.006 :<\/strong> Un arr\u00eat de travail post\u00e9rieur \u00e0 la d\u00e9claration d\u2019inaptitude n\u2019ouvre pas une nouvelle p\u00e9riode de suspension du contrat de travail. La mauvaise foi du lanceur d\u2019alerte ne peut r\u00e9sulter que de la connaissance par le salari\u00e9 de la fausset\u00e9 des faits qu&#8217;il d\u00e9nonce. La seule circonstance que les faits d\u00e9nonc\u00e9s ne sont pas \u00e9tablis ne suffit pas.<\/p>\n<p>&nbsp;<\/p>\n<h4>Preuve.<\/h4>\n<p><strong>Cass. soc., 30 septembre 2020, n\u00b019-12.058 :<\/strong> l\u2019employeur est autoris\u00e9 \u00e0 produire en justice une publication litigieuse sur Facebook qui lui avait \u00e9t\u00e9 spontan\u00e9ment communiqu\u00e9e par un courriel d\u2019une autre salari\u00e9e de l\u2019entreprise. Celle-ci \u00e9tait autoris\u00e9e \u00e0 acc\u00e9der comme \u00ab amie \u00bb sur le compte priv\u00e9 <strong>Facebook<\/strong> du salari\u00e9. Le proc\u00e9d\u00e9 d\u2019obtention de preuve n\u2019est pas d\u00e9loyal.<\/p>\n<p><strong>Note sur l\u2019arr\u00eat :<\/strong> &nbsp;La photographie \u00e9tait extraite du compte priv\u00e9 Facebook d\u2019une salari\u00e9e communiqu\u00e9e par une de ses \u00ab amies \u00bb sur ce r\u00e9seau social \u00e0 l\u2019employeur. La Cour de Cassation reconna\u00eet que la production en justice de cette photo du compte priv\u00e9 Facebook de la salari\u00e9e est constitutive d\u2019une atteinte \u00e0 la vie priv\u00e9e. Toutefois, cette atteinte a \u00e9t\u00e9 admise car elle \u00e9tait indispensable \u00e0 l\u2019exercice du droit \u00e0 la preuve et proportionn\u00e9e au but poursuivi, c\u2019est-\u00e0-dire \u00e0 la d\u00e9fense de l\u2019int\u00e9r\u00eat l\u00e9gitime de l\u2019employeur, \u00e0 savoir la confidentialit\u00e9 de ses affaires.<\/p>\n<p>&nbsp;<\/p>\n<h4>D\u00e9nigrement sur les r\u00e9seaux et licenciement.<\/h4>\n<p><strong>Cass. soc., 30 septembre 2020, n\u00b019-10.123 :<\/strong> Le licenciement d\u2019un salari\u00e9 qui a d\u00e9nigr\u00e9 l\u2019entreprise notamment sur une page de son compte Facebook accessible au public, est sans cause r\u00e9elle et s\u00e9rieuse d\u00e8s lors que les messages diffus\u00e9s par l\u2019int\u00e9ress\u00e9 ne contenaient pas de termes injurieux, diffamatoires ou excessifs visant explicitement l\u2019employeur.<\/p>\n<p>&nbsp;<\/p>\n<h4>Modification du contrat de travail.<\/h4>\n<p><strong>Cass. soc., 14 octobre 2020, n\u00b019-14.182 :<\/strong> la modification du contrat de travail d&#8217;un salari\u00e9 impos\u00e9e sans son accord peut caract\u00e9riser un trouble manifestement illicite, relevant de la comp\u00e9tence du juge des r\u00e9f\u00e9r\u00e9s, juge de l\u2019urgence et de l\u2019\u00e9vidence. L\u2019employeur peut alors \u00eatre contraint par le juge de le r\u00e9affecter \u00e0 son poste et de lui fournir un travail en lien avec ses fonctions.<\/p>\n<p>&nbsp;<\/p>\n<h4>Obligations de formation et d\u2019entretien professionnel.<\/h4>\n<p><strong>Cass. soc. 16 septembre 2020, no 18-19.889 :<\/strong> Un salari\u00e9 peut obtenir des dommages-int\u00e9r\u00eats pour violation de l\u2019obligation l\u00e9gale et conventionnelle de formation et d\u2019entretien professionnel depuis l\u2019ann\u00e9e 2014, m\u00eame s\u2019il n\u2019a jamais express\u00e9ment sollicit\u00e9 d\u2019entretien ni aucune formation \u00e0 son poste de travail.<\/p>\n<p>&nbsp;<\/p>\n<h4>Rupture conventionnelle.<\/h4>\n<p><strong>Cass. soc., 23 septembre 2020, n\u00b018-25.770 :<\/strong> Pour garantir l\u2019effectivit\u00e9 d\u2019une rupture conventionnelle, un exemplaire de la convention doit \u00eatre remis par l\u2019employeur au salari\u00e9 d\u00e8s sa signature. Il &nbsp;appartient \u00e0 l\u2019employeur de d\u00e9montrer qu\u2019il a effectu\u00e9 cette remise.
